These are the KANIVA Shop Order, Agreement, and Terms of Use for the website “kaniva.fi/kauppa” (Business ID: 1957641-3), operated by KANIVA, located at Kuurnan Rantatie 25, 80850 Paihola, FINLAND. Email: info@kaniva.fi.

These terms and conditions were updated on January 11, 2024, and take effect immediately.
1. Parties to the Agreement
These KANIVA Shop Order and Terms of Service (“Terms”) form an agreement between you (“Customer”) and KANIVA, as well as the sellers/merchants (“Online Store” or “Seller”), through which the KANIVA shop provides the service (“Service”).
2. Applicability
These Terms apply to all orders and purchases made in the Online Store. The Customer and Seller must read and accept these Terms before placing an order. By using the Online Store and placing an order, the Customer accepts these Terms in full.
3. Products and Prices
Products and prices offered in the Online Store are displayed on the website, all prices including VAT. The Online Store strives to ensure the accuracy of product and price information, but does not guarantee it is error-free.
4. Placing an Order
The Customer may place an order in the Online Store by adding products to the shopping cart and following the ordering process. During the order, the Customer must provide certain information, such as delivery address and payment details. Contact information requested during the order is used only for order delivery or resolving any issues, unless otherwise stated. By ordering from the Online Store, the Customer is deemed to have reviewed and accepted the applicable delivery terms. The Customer confirms the order by submitting it to the Seller.
5. Payment
Payments are made using the payment methods provided by the Online Store. The Online Store may offer different payment methods, and both Customer and Seller must comply with the terms of the chosen method. Payments are made in euros. For complaints, please contact the product Seller first.
6. Delivery and Shipping Costs
Typical delivery times are 2–6 business days within Finland and 4–11 business days within Europe if the Seller ships the product the next day. Therefore, the Online Store cannot guarantee a specific delivery time. KANIVA is not responsible for delays caused by force majeure or any indirect losses resulting from delays. KANIVA is also not responsible for delays caused by circumstances beyond our control.
Delivery options are defined by each Seller, for example, domestic postal delivery starting at €5.90 depending on weight. For EU and other countries: delivery by postal service, Matkahuolto, or equivalent courier, depending on Seller’s choice. Sellers may include shipping costs in the product price, which must be clearly indicated.
KANIVA is not responsible for lost or damaged packages during delivery. When ordering from our Online Store, responsibility transfers to the courier at the time of delivery. We recommend tracking deliveries if tracking is available from the Seller. In case of issues, contact the courier immediately or our customer service for assistance.
7. Cancellation and Returns
You have the statutory right to cancel your order within 14 days of receiving it. The cancellation notice must include your name, address, order date, product, and account number for refund, and be sent to the Seller by email with a copy to verkkokauppa@kaniva.fi. Products must be returned by post within 14 days in original condition. Return costs are the Customer’s responsibility. Attach a copy of the cancellation notice to the returned product. If a product has been used, the Seller may deduct value depreciation or refuse a refund.
The right of cancellation does not apply to custom-made or modified products at the Customer’s request. It does not apply to goods or services delivered in digital form (e.g., PDF instructions, online courses, images).
Unclaimed Package
Failure to claim a package is not the same as a return or cancellation. For unclaimed packages without a separate cancellation notice, the Seller may charge €10 in addition to postage to cover costs.
8. Problem Resolution
If a product is lost, damaged during transport, or does not match your order, report the issue within 14 days of receipt to the Seller listed in the Cancellation and Return section. You may also contact us at verkkokauppa@kaniva.fi for assistance.
9. Limitation of Liability
The Online Store is not responsible for misuse of products or damage caused by the Customer. The Online Store is also not responsible for defects or shortcomings in products.
10. Grant of License
The Seller grants KANIVA and its business partners an unlimited, worldwide, and irrevocable license to all material the Seller shares in the Service or on the KANIVA Shop website, including images, text, videos, and other sales materials, for advertising and marketing purposes. This includes modifying, distributing, and using the material across any promotional channels. The Seller retains the right to use the same material for their own marketing.
11. Copyright
All content available through the KANIVA Shop across EU countries—including text, graphics, logos, buttons, images, audio clips, digital downloads, and data compilations—is owned by KANIVA or its content providers and protected by national and international copyright laws. Compilation of all content available via KANIVA Shop is exclusively owned by KANIVA and protected under applicable copyright laws.
12. Product Copy Protection and Seller Responsibility
Sellers agree to follow strict ethical standards and avoid copying other Sellers’ products. Sellers guarantee that their products are original and do not infringe copyrights, trademarks, or other intellectual property. Sellers are fully liable to KANIVA for any copied or infringing products.
KANIVA reserves the right to take legal action against Sellers violating this rule, and the Seller agrees to compensate for any damages and legal costs arising from infringements.
This applies throughout the Seller’s participation and after leaving the KANIVA platform.
13. Liability and Compensation in the KANIVA Shop
13.1. KANIVA’s Liability
The KANIVA Shop, a platform consisting of multiple sellers across the EU, is liable for direct damages caused to the Customer or Seller due to KANIVA’s negligence. KANIVA’s liability for compensation is limited to damages that exceed any refunds granted to Customers under these Terms of Use.
KANIVA shall in no circumstances be liable for indirect damages caused to Customers through the Service or for any other reason. KANIVA is not responsible for damages resulting from malfunction of the Service, service interruptions, inability to use the Service, errors or deficiencies in the Service, termination of the Service, or any faults or disruptions affecting the Customer’s devices or software.
KANIVA is responsible for the legality of the content it produces itself. KANIVA is not responsible for content delivered or made available through the Service, nor for its reliability. All products listed through the Service are provided by the Seller “as is,” without any warranties, and their purchase and use are at the Customer’s own risk.
KANIVA is also not responsible for services provided by Sellers or their content, including any related copyrights or other intellectual property rights.
Any claim for damages must be submitted to KANIVA within two months from the time the Customer discovered or should have discovered the basis for the claim. For paid Services, KANIVA’s total liability for damages is limited to the amount of fees paid by the Customer for the Service during the period in which the damage occurred.
13.2. Seller’s Liability
In the KANIVA Shop, the Seller is responsible for the legality of the products they offer and for any damages resulting from the Seller’s actions. The Seller agrees to comply with applicable legislation and the KANIVA Terms of Use. The Seller is also responsible for any potential intellectual property infringements and must ensure that the sale of their products does not violate the Terms of Use, the law, or accepted business practices.
The Seller shall compensate KANIVA or any third party for damages caused by the Seller. The Seller is also responsible for customer returns, possible complaints, and any costs or damages resulting from the Seller’s actions.
The Seller is responsible for properly handling the delivery and return of their products and for ensuring that the products correspond to the information provided in the sales listing. The Seller is also responsible for any warranties or other commitments related to their products given to Customers.
14. Risk of Loss
All purchases of physical products in the KANIVA Shop are delivered in accordance with the “Delivery and Shipping Costs” section. This means that the risk of loss and ownership of such products transfer to the Customer when the Seller hands them over to the carrier with proof of shipment (tracking number).
15. Privacy Protection
The Online Store processes the Customer’s personal data in accordance with its privacy policy. More information about the processing of personal data can be found in KANIVA’s Privacy Policy.
16. Applicable Law and Dispute Resolution
These Terms and all orders are governed by Finnish law. Any disputes shall primarily be resolved through negotiation. If negotiations do not lead to a resolution, disputes shall be settled in the general courts of Finland.
17. Changes to the Terms
The Online Store may modify these Terms by announcing the changes on its website. The changes will take effect from the specified date. Customers are encouraged to review the Terms regularly for any updates.
18. Disclaimer
KANIVA provides the best translation services it has available on this website. Although we make every effort to provide accurate and high-quality translations, we cannot guarantee complete accuracy or prevent possible misunderstandings. KANIVA assumes no liability for any errors, misunderstandings, omissions, or damages that may arise from the use of translations. By using this service, the Customer accepts that they are responsible for checking and verifying the accuracy and suitability of translations for their intended purpose.
